Owner/Operator: Doctors Explain Digital Health Co. LTD (“MedicalTV”, “we”, “us”, “our”) operating the AI4Good Medical Magazine brand as part of the MedicalTV.live ecosystem.
By accessing, browsing, registering, submitting content to, or otherwise using the Platform, you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Platform.
1) Definitions

“Content” includes articles, videos, audio, images, graphics, text, data, research summaries, newsletters, reports, comments, and other materials displayed or made available on the Platform.

“User” means any person who accesses or uses the Platform.

“UGC” means user-generated content (comments, submissions, uploads, messages, posts).

“Services” means any digital services offered through the Platform (e.g., newsletters, webinars, paid subscriptions, advertising packages, sponsored content placements, event registrations, membership accounts).
2) Platform Purpose and Medical Disclaimer (No Doctor–Patient Relationship)

The Platform provides health, AI, digital health, and medical-technology journalism and educational content.

Not Medical Advice: Content is for general information and educational purposes only and does not constitute medical advice, diagnosis, or treatment.

No Clinical Relationship: Use of the Platform does not create a doctor–patient relationship.

Emergency: If you believe you may have a medical emergency, call your local emergency number or go to the nearest health facility immediately.

Professional Consultation: Always seek advice from a qualified clinician for medical conditions.
3) Eligibility and Account Registration

You must be at least 18 years old (or have valid parental/guardian consent) to create an account or purchase any paid Service.

You agree that information you provide is accurate and that you will keep it updated.

You are responsible for safeguarding passwords and account access. You must notify us immediately of unauthorized use.
4) Acceptable Use (User Conduct)
You agree not to:

Use the Platform for unlawful purposes, including conduct that may contravene Kenya’s cybercrime laws (new.kenyalaw.org).

Post content that is defamatory, false, harassing, hateful, threatening, discriminatory, or that infringes others’ rights (including under defamation principles and civil remedies) (new.kenyalaw.org).

Upload malware, attempt unauthorized access, disrupt services, scrape content at scale, or interfere with Platform security.

Impersonate others, misrepresent affiliations, or mislead readers about credentials.

Collect personal data from users without lawful basis.
We may suspend or terminate access for violations.
5) Editorial Independence, Sponsored Content, and Advertising

We may publish sponsored content, advertorials, or paid placements. We will endeavor to label sponsored content clearly.

Opinions expressed by authors/interviewees do not necessarily reflect our views.

We do not guarantee that any product, service, AI tool, or clinical claim featured is accurate, safe, or effective. Users should conduct independent assessment and professional consultation.
6) Intellectual Property (Copyright, Trademarks, Permissions)

Unless stated otherwise, all Platform Content is owned by or licensed to MedicalTV and is protected under Kenya’s copyright law (new.kenyalaw.org).

You may view and share links to Content for personal, non-commercial purposes.

You may not reproduce, distribute, modify, republish, sell, or commercially exploit Content without prior written permission.

Trademarks, logos, and brand identifiers remain our property or the property of respective owners.
DMCA-style notice (Kenya practice): If you believe Content infringes your rights, email magazine@medicaltv.live with: (a) identification of the work, (b) location/URL, (c) proof of ownership/authority, and (d) your contact details.
7) User-Generated Content (UGC) License and Moderation

If you submit UGC, you represent you have the rights to submit it and it does not violate law or third-party rights.

You grant MedicalTV a worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, translate, distribute, and display your UGC for Platform operation, moderation, marketing, and archival purposes.

We may remove or moderate UGC at our discretion (without obligation) to protect users, comply with law, or uphold editorial standards.
8) Privacy and Data Protection (Kenya)

We process personal data in line with the Data Protection Act, 2019 and guidance/oversight of the Office of the Data Protection Commissioner (ODPC) (odpc.go.ke).

Our Privacy practices (collection, use, lawful basis, retention, sharing, cross-border transfers, security safeguards, and data subject rights) are detailed in our Privacy Policy (to be published/linked).

You agree not to submit sensitive personal data (including health data) in public areas (e.g., comments). If you do, you do so at your own risk.
9) Cookies and Analytics

We may use cookies or similar technologies for functionality, analytics, and security.

You can manage cookies in your browser settings; some Platform features may not function properly if cookies are disabled.
10) Subscriptions, Payments, and Consumer Rights (If Applicable)
If the Platform offers paid plans, tickets, or digital goods/services:

Prices will be shown in the applicable currency and may include/omit taxes as disclosed at checkout.

Where the Consumer Protection Act applies, we will not engage in unfair, misleading, or deceptive practices and will provide clear disclosures of material terms (new.kenyalaw.org).

Refunds/cancellations (if any) will be governed by the specific plan terms presented at purchase and applicable law.

Chargebacks: abusive chargebacks may result in suspension/termination.
11) Third-Party Links and Tools

The Platform may link to third-party websites, AI tools, medical devices, or services. We do not control and are not responsible for third-party content, policies, or practices.

Your use of third-party services is governed by their own terms and privacy policies.
12) AI and Accuracy Disclaimer (AI in Healthcare Journalism)

Content may include discussion of AI models and tools. AI outputs can be inaccurate, biased, or incomplete.

Any clinical or technical information should be validated using authoritative sources and professional judgment.
13) Security, Prohibited Technical Activities, and Reporting

Unauthorized access attempts, probing, or interference may breach Kenya’s cybercrime laws (new.kenyalaw.org).

If you discover a vulnerability, please report responsibly to magazine@medicaltv.live. Do not publicly disclose without giving us reasonable time to address it.
14) Notices and Electronic Communications

You consent to receiving communications electronically (email, website notices, or in-app messages).

Electronic records and signatures may be recognized for evidentiary purposes under Kenyan law (new.kenyalaw.org).
15) Termination
We may suspend or terminate your access (with or without notice) if:

You violate these Terms;

Required by law or a regulator; or
-
We discontinue the Platform or a Service.
Termination does not affect accrued rights/obligations and clauses that should survive (IP, disclaimers, indemnities, governing law, dispute resolution).
16) Disclaimers

The Platform is provided “as is” and “as available”.

We do not warrant uninterrupted availability, accuracy, or error-free operation.

We do not warrant that Content will meet your needs or that defects will be corrected immediately.
17) Limitation of Liability
To the maximum extent permitted by law:

MedicalTV shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Platform.

Our total liability for any claim related to the Platform shall be limited to the amount (if any) you paid us for the relevant Service in the 3 months before the event giving rise to the claim.
Nothing in these Terms limits liability where it cannot be limited by law.
18) Indemnity
You agree to indemnify and hold harmless MedicalTV, its directors, officers, employees, contractors, and partners from claims, damages, losses, and expenses arising from:

Your misuse of the Platform;

Your UGC;
-
Your violation of these Terms or third-party rights.
19) Governing Law and Jurisdiction (Kenya)

These Terms are governed by the laws of the Republic of Kenya.

Subject to the dispute resolution clause below, courts of competent jurisdiction in Nairobi, Kenya shall have jurisdiction.
20) Dispute Resolution (Escalation + Arbitration Option)

Informal Resolution: Parties will first attempt to resolve disputes by contacting magazine@medicaltv.live within 14 days of the dispute arising.

Arbitration (Optional but recommended for speed): If not resolved, disputes may be referred to arbitration seated in Nairobi under Kenya’s Arbitration Act (new.kenyalaw.org), by a single arbitrator appointed by mutual agreement (or per the Act if no agreement).

Court Relief: Either party may seek urgent injunctive relief from a competent court (e.g., IP infringement, data breach containment).
(If you prefer court-only, remove the arbitration sub-clause.)
21) Changes to These Terms
We may update these Terms from time to time. Updates take effect when posted on the Platform with a revised “Effective Date.” Continued use after changes means you accept the updated Terms.
22) Severability
If any provision is held invalid or unenforceable, the remainder of the Terms remains in effect.
23) Assignment
You may not assign your rights/obligations without our written consent. We may assign these Terms as part of restructuring, acquisition, or asset transfer.
